1. Agreement and Publisher
These Terms of Service (“Terms”) are an agreement between you and Maksim Arsic (“Publisher,” “I,” “me,” or “my”) concerning the Truck Boss mobile game, related content, website, purchases, and services (collectively, the “Game”). The Game is distributed through Apple’s App Store.
2. Eligibility and Minors
You must be legally permitted to enter this agreement. The Game is not directed to children under 13. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms and supervise purchases. You are responsible for complying with Apple family, Ask to Buy, and parental-control settings.
3. License
Subject to these Terms and Apple’s applicable usage rules, the Publisher grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Game on Apple-branded devices that you own or control, solely for personal, non-commercial entertainment.
No rights are granted except those expressly stated. The Game is licensed, not sold.
4. Apple-Specific Terms
You acknowledge that these Terms are between you and the Publisher, not Apple. The Publisher, not Apple, is solely responsible for the Game and its content, maintenance, support, warranties, and claims, except as otherwise required by law.
- Your license is limited to Apple-branded products that you own or control, subject to App Store usage rules and permitted Family Sharing or volume-purchase use.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
- The Publisher, not Apple, is responsible for addressing product claims, consumer-protection claims, regulatory claims, and intellectual-property claims relating to the Game.
- You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. prohibited or restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
5. Nature of the Game
Truck Boss is fictional entertainment. Trucks, companies, earnings, depreciation, contracts, driver arrangements, values, and other systems are simplified game mechanics. The Game is not real-world trucking, business, investment, tax, legal, employment, or financial advice.
6. Local Saves and Progress
Most progress is stored locally on your device. You are responsible for your device, Apple Account, and backups. Deleting the Game, resetting data, changing devices, restoring an older backup, device failure, or software errors may cause progress to be lost. Game Center does not guarantee backup or transfer of your local save.
The Publisher may use reasonable anti-tampering and clock-integrity measures. Manipulating device time, game files, transactions, ads, or code may result in corrected balances, revoked rewards, lost progress, disabled features, or termination of the license.
7. Virtual Currency and Items
Company cash, trucks, electric trucks, drivers, dispatchers, parking spaces, badges, rewards, and all other game items are fictional, limited licenses within Truck Boss. They are not money, securities, property, stored value, or redeemable outside the Game.
Virtual items cannot be transferred, sold, gifted, traded, or exchanged unless the Game expressly provides that feature. Game economy values, rewards, availability, and balance may be adjusted, corrected, limited, or discontinued, subject to applicable law.
8. In-App Purchases
Optional purchases are processed by Apple through StoreKit. Apple controls payment methods, billing, taxes, authentication, refunds, and regional pricing. The Publisher does not receive your payment-card details.
- Consumables are generally used once and are not normally restorable.
- Non-consumables may be restorable through the Restore Purchases feature when supported.
- Restoration must not duplicate consumable rewards or one-time grants.
Refund requests are handled by Apple except where applicable law requires otherwise. You are responsible for purchases authorized through your Apple Account and device.
9. Rewarded Advertising
Rewarded ads are optional. A reward is granted only after the advertising provider reports successful completion. Ads and rewards may be unavailable or delayed due to consent choices, network conditions, device compatibility, region, fraud prevention, or technical problems. You may not automate, manipulate, or fraudulently generate ad views or rewards.
10. Game Center and Leaderboards
Game Center is an optional Apple service. If used, your Game Center display name and submitted company-value score may be visible to other users. Fraudulent, manipulated, abusive, or technically invalid scores may be rejected, reset, or removed. Apple’s terms and settings also apply.
11. Notifications, Audio, Haptics, and Device Use
Notifications, music, sound effects, truck ambience, and haptics are optional and may be managed through Truck Boss or iOS Settings. Notifications are not guaranteed to arrive at a particular time. You are responsible for device volume, hearing safety, battery use, network charges, and settings.
12. Acceptable Use
You may not:
- Reverse engineer, decompile, disassemble, derive source code, bypass security, or create unauthorized derivative works, except where applicable law expressly permits it.
- Use cheats, bots, scripts, automation, modified clients, unauthorized tools, clock manipulation, transaction manipulation, ad fraud, or exploits.
- Interfere with the Game, Apple services, Google services, purchases, advertising, security, networks, or other users.
- Use the Game for unlawful, fraudulent, abusive, infringing, commercial-resale, or unauthorized advertising purposes.
- Copy, scrape, distribute, sell, rent, sublicense, or publicly exploit Game content except as expressly allowed.
- Impersonate another person or submit malicious, false, or unlawful support or privacy requests.
13. Intellectual Property
The Game, software, code, design, user interface, art, music, sounds, branding, fictional names, and other content are owned by the Publisher or licensed to the Publisher and are protected by intellectual-property laws. Third-party trademarks, technology, assets, and services remain the property of their respective owners.
Truck Boss is not affiliated with or endorsed by real-world truck manufacturers unless expressly stated.
14. Third-Party Services
The Game relies on services provided by Apple, Google, Cloudflare, and potentially other providers. Those services may be governed by separate terms and privacy policies and may change or become unavailable. The Publisher is not responsible for third-party services except to the extent required by law.
15. Updates and Availability
Updates may be required to continue using the Game. The Publisher does not guarantee that the Game will always be available, uninterrupted, error-free, compatible with every device or operating-system version, or that every feature, item, ad, notification, purchase, save, or leaderboard will remain unchanged.
All or part of the Game may be modified, suspended, or discontinued for maintenance, security, legal, technical, platform, or business reasons, subject to applicable law.
16. Suspension and Termination
You may stop using the Game at any time by deleting it. The Publisher may suspend access, correct balances, revoke improperly obtained rewards, disable features, or terminate the license if there is a reasonable belief of fraud, abuse, security risk, violation of these Terms, or a legal or platform requirement.
Upon termination, your license ends. Sections that logically should survive—such as intellectual property, disclaimers, limitations, and disputes—remain effective.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE.” THE PUBLISHER DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
No guarantee is made that the Game will be uninterrupted, error-free, free of harmful components, compatible with every device, or that saves, rewards, items, ads, purchases, notifications, or leaderboards will never be lost, delayed, or changed. Mandatory consumer warranties remain unaffected where they cannot legally be excluded.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, SAVES, GOODWILL, OR BUSINESS; DEVICE DAMAGE; OR SUBSTITUTE-SERVICE COSTS ARISING FROM THE GAME.
To the maximum extent permitted by law, total liability arising from the Game will not exceed the greater of (a) the amount you paid through the Game during the 12 months before the event giving rise to the claim or (b) 100 U.S. dollars. This does not limit liability that cannot legally be limited.
19. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless the Publisher and service providers from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use, fraud, infringement, or material violation of these Terms. This section does not apply where prohibited by consumer law.
20. Governing Law and Disputes
These Terms are governed by California law and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to mandatory consumer rights, disputes not resolved informally will be brought in state or federal courts located in Los Angeles County, California.
If you live outside the United States, mandatory consumer protections and courts in your home jurisdiction may apply. Before filing a claim, email info@amaxdistribution.com and allow a reasonable opportunity to resolve the issue.
21. Export and Sanctions
You may not use or export the Game in violation of U.S. export-control or sanctions laws. You represent that you are not prohibited from receiving U.S.-origin software or services.
22. Changes to These Terms
These Terms may be updated to reflect changes in the Game, law, platform requirements, or business practices. The effective date will be updated, and additional notice will be provided when required. Continued use after the effective date constitutes acceptance where legally permitted.
23. Miscellaneous
These Terms, the Privacy Policy, and Apple’s applicable standard license terms form the agreement concerning the Game. If a provision is unenforceable, it will be modified only as much as necessary, and the rest will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without permission; the Publisher may assign them in connection with a transfer of the Game or by operation of law.
